The preliminary investigation under the criminal proceedings initiated by the National Security Service of the Republic of Armenia and investigated by the Anti-Corruption Committee of the Republic of Armenia established that V. M., holding the position of the acting head of the conscription department of one of the territorial military commissariats of the Ministry of Defense of the Republic of Armenia, using his official powers and the influence arising from them, with the assistance of the director of one of the medical centers, with the aim to commit illegal actions in favor of a number of conscripts, namely to create grounds for granting a deferment from military service or exemption from regular military service on the basis of false medical diagnoses, demanded from various persons and received bribes in particularly large sizes, totaling USD 125,000.
In particular, in December 2022, V.M., having learned that the director of one of the medical centers A.M. has the opportunity to obtain medical conclusions with a diagnosis of “arachnoid cyst,” which is considered a basis for the exemption of conscripts from military service, with the purpose to commit illegal actions in favor of 5 different conscripts, he offered to obtain and provide the mentioned false conclusions against a reward.
A.M., in his turn, entered into an agreement with his acquaintance E.H., who had the above diagnosis, so that the latter would fraudulently undergo examination in various medical institutions instead of the conscripts specified by V.M., promising to provide AMD 20,000 for each examination.
Based on the agreement reached, E. H. underwent examinations in various medical centers of Yerevan instead of conscripts, presenting identification documents of the above-mentioned conscripts within the period from January to July 2023. As a result, false conclusions were drawn up under the names of the conscripts, which A.M. provided to V.M. The latter, in order to create grounds for the release of the above-mentioned 5 conscripts from military service on the basis of these documents, demanded and received a bribe in the amount of USD 25,000 in each case, of which USD 2,000-3,500 he passed over to A. M. In total, V. M. demanded and received a particularly large amount of USD 125,000 for committing illegal actions in favor of conscripts.
V. M. was charged under Article 435, Part 3, Clause 3 (5 episodes) and Article 441, Part 2, Clause 5 of the RA Criminal Code, and A. M., who assisted him, was charged under Article 46-435, Part 3, Clause 3 (5 episodes), Article 46-441, Part 2, Clause 5 and Article 46-44-461, Part 2, Clause 2 of the RA Criminal Code.
As a measure of restriction, arrest was applied against V.M.
The preliminary investigation under the criminal proceedings has been completed, and the materials of the proceedings have been sent to the court with an indictment for consideration on the merits.
Notification. the person accused of a crime is considered innocent until his guilt is proven in accordance with the procedure established by the RA Criminal Procedure Code by a verdict entered into legal force.
