The preliminary investigation carried out in RA Anti-Corruption Committee under the criminal proceedings justified that K. G., holding the position of the chief specialist of the department of urban planning, land construction, agriculture and real estate management of Abovyan municipality of Kotayk marz, using his official powers and the influence caused by them, received a bribe for illegal inaction in favor of A. M. and the person specified by him.
In particular, the preliminary investigation revealed that E. G. applied to Abovyan municipality in January 2023 for the purpose of obtaining permission to start construction works on the land plot owned by his wife in the Abovyan community of Kotayk region, however, without waiting for the relevant decision, he agreed with the director of the "S.A. Group" LLC about beginning the land works on the specified site.
At that time, К. G., an employee of Abovyan municipality, while performing the supervisory functions arising from his authorities, discovered the ongoing illegal construction and demanded to stop it. Аnd А. M. through the mediation of one of his acquaintances, met with the mentioned official of the municipality and addressed to the latter with a request to continue the works on the site until obtaining the construction permit. K. G. agreed and for illegal inaction, namely, for not protocoling the detected violation, received a bribe from A. M. in the amount of AMD 100,000.
For the above-mentioned criminal acts, K. G. was charged under Article 435, Part 2, Clause 3 of RA Criminal Code, and A. M. - under Article 436 Part 2 Clause 3.
The preliminary investigation under criminal proceedings has been completed. The indictment is confirmed by the prosecutor, and materials of the proceedings are filed to the court for consideration on the merits.
Notification. the person accused of a crime is considered innocent until his guilt is proven in accordance with the procedure established by the RA Criminal Procedure Code by a verdict entered into legal force.
