The day before, RA Judicial Department issued a statement, citing, in particular, the remark of the Chairman of RA Anti-Corruption Committee Sasun Khachatryan, made on that same day at the meeting of RA Government regarding a specific criminal case, that the court released all the accused from custody after accepting the criminal proceedings. “I don’t want to discuss the court’s decision at all, but we have a situation where, as practice shows, court hearings drag on for years, if not in custody, that's a problem.”
The Judicial Department, considering the above facts as an accusation against the judicial authorities, issued a statement regarding the bases for applying measures of restriction against the accused in a specific criminal case and the sufficiency of the evidences presented by the inquiry bodies.
In fact, the Judicial Department, as an office of the Supreme Judicial Council, called to ensure the functioning of the Supreme Judicial Council, courts, the general meeting of judges and its committees, as well as the participation of the mentioned bodies in civil, treasury, procurement, financial, economic and other property legal relations, tried to comment on judicial acts and evidences presented by the preliminary investigation body, which it has no authority for.
Moreover, having assigned to itself the function of interpreting the application of the law, which is the function of other law enforcement bodies, it made certain textbook analyses of the meaning of measures of restriction, the purposes of their application, and then, on behalf of the judiciary, expressed his willingness to present his justifications and concerns to the public, other fields of the government and independent bodies in public discussions.
Refraining from public discussion of court decisions made by courts for criminal cases under judicial investigation and evaluation of evidences, the Anti-Corruption Committee will also refrain from responding the comments contained in the statement of the Judicial Department in this regard, especially considering that the body that disseminated the said statement also does not have any such authority.
