With the preliminary investigation carried out in the criminal proceedings initiated by the RA Anti-Corruption Committee, it was substantiated that security officers of Nubarashen penitentiary of the RA MD H. Kh. and A. G., being officially authorized to ensure the maintenance of internal service and security in the penitentiary, regularly received around 2,827,800 AMD bribes, from the convicts of the same institution in order to commit an obvious illegal act with prior consent, to transfer mobile phones to the said penitentiary.
In particular, it was found that in January 2022 “Nubarashen” penitentiary officer H. Kh. accepted a large bribe offer from convicts R. E. and V.H. in exchange for transferring means of communications, including mobile phones and charging devices, which are prohibited items, to the territory of the penitentiary and providing to them. After that, the wives of the mentioned convicts, having acquired the mobile phones and the items included in their kit, handed them over to the prison official on different days in pre-arranged places. The latter transferred those prohibited items to the penitentiary and delivered them to the convicts. The convicts regularly transferred through their wives, various sums of money, in total 2,827,800 AMD as bribes to the bank account provided by the prison official for the said illegal act.
Moreover, by the preliminary investigation it was substantiated that H. Kh. received AMD 60,000 of the above-mentioned bribe as a member of the group with A. G., the specialist from the security department of the same institution. H. Kh. asked the latter to ensure his unhindered passage to the special storage area of the penitentiary for holding prohibited items, for which he transferred AMD 60,000 as a bribe to A. G.’s bank card.
On May 7, 2022, after accepting another 300,000 AMD bribe offer to transfer a new batch of prohibited communication means being a prohibited items (14 mobile phones) to one of the convicts, H. Kh. again transported them to “Nubarashen” penitentiary, but was caught by NSS officers while passing through the checkpoint.
H. Kh. was charged under points 1, 2 and 3 of part 2 of article 435 of the RA Criminal Code, for receiving a bribe in large amounts, A. G. was charged under points 1 and 3 of part 2 of article 435, convicts R. E. and V. H. was charged under points 2 and 3 of part 2 of article 436 of the RA Criminal Code for bribing officials of the Penitentiary Institution.
Convicts’ wives were also charged with assisting bribery.
The preliminary investigation in the criminal proceedings has been completed. The materials of the proceedings with the indictment were handed over to the supervising prosecutor, who approved it and sent it to the court.
Notification. the person accused of a crime is considered innocent until his guilt is proven in accordance with the procedure established by the RA Criminal Procedure Code by a verdict entered into legal force.
