According to the criminal proceedings carried out in the RA Anti-Corruption Committee, it was proved that R. S., occupying the position of judge assistant of the court of first instance of general jurisdiction of Gegharkunik marz, embezzled money from the convict by fraudulently using his official position.
In particular, it was found out that R. S. made acquaintance with S. H., a resident of Dilijan city, who was found guilty of committing an act stipulated by Article 242, part 2 of the RA Criminal Code, and was sentenced to imprisonment by the verdict of the General Jurisdiction Court of Gegharkunik Marz on July 8, 2016. After that, on June 21, 2017, the defense attorney of the convict submitted an application to the General Jurisdiction Court of Gegharkunik Marz on replacing the punishment in the form of imprisonment appointed for S.H. with public works.
Judge Assistant R. S., being informed about the above-mentioned application and aiming to embezzle money from the convict by fraud, informed S. H. that in order to replace imprisonment with public works, it is necessary to make a state payment of 300,000 AMD, while no such payment was stipulated by law.
As a result, R. S. met with convict S. H. in Vanadzor city and received the sum of AMD 300,000 from him.
Examining S. H.'s defense attorney's application, the court of first instance of general jurisdiction of Gegharkunik marz made a decision to send the mentioned application according to subjugation, after which at the request of convict S. H., R. S. returned the mentioned amount to him.
R. S. was charged with the criminal act provided by Article 178, part 2, point 1.1 of the RA former Criminal Code.
The investigation is over. The materials of the criminal proceedings with indictment were handed over to the supervising prosecutor with a request to approve it and send it to the court.
Notification. the person accused of a crime is considered innocent until his guilt is proven in accordance with the procedure established by the RA Criminal Procedure Code by a verdict entered into legal force.
