During the preliminary investigation of the criminal proceedings investigated by the RA Anti-Corruption Committee, it was established that B. H., occupying the position of manager of one of the cemeteries of Yerevan city and being an official person, demanded and received a bribe of AMD 200,000 from him for the obvious illegal inactivity in favor of E.P.
In particular, in May 2022, while carrying out its operational duties, B.H. discovered that the dimensions of the grave of M.P. buried in the cemetery exceeded the 2.5x5 square meters defined by the law, after which, instead of taking measures in the prescribed manner in connection with the found violation, called the son of the deceased, E.P., to report him about the found violation, and then met him and demanded a bribe from him to settle the problem. As a result, B.H. on May 12, 2022, through the bank transfer made by E. P's wife, received AMD 200,000 as a bribe from E.P., for which he refrained from performing his operational duties, showing obvious illegal inactivity.
For committing the above-described criminal acts, B. H. was charged under Article 311, part 2 (entered into force on August 1, 2003 and expired on July 1, 2022) of the RA Criminal Code in force at the time of committing the act, and E.P. - under Article 312, part 1.
The preliminary investigation of the criminal proceedings has been completed. The materials of the proceedings with the indictment were handed over to the supervising prosecutor with a request to approve it and send it to the court.
Notification. the person accused of a crime is considered innocent until his guilt is proven in accordance with the procedure established by the RA Criminal Procedure Code by a verdict entered into legal force.
