In the framework of the criminal proceedings initiated as a result of joint work with the RA National Security Service in the RA Anti-Corruption Committee, cases of the importation of RA perfume, as well as the failure to carry out proper customs control in the process of the export of tobacco from RA and giving a bribe to an official of the SRC employee in exchange for the unhindered transportation of goods across the RA border, were revealed.
During the preliminary investigation, it was found out that the RA citizen, individual entrepreneur A. Kh. turned to his acquaintance A.M., an official whose powers of the RA SRC had been temporarily suspended, to assist him in hiding the perfume imported to RA from customs control and not paying the customs duties prescribed by law. The latter reached an agreement with the competent official of the Customs Service of the RA SRC in order to support A.K. in the above-mentioned matter, who, accepting the offer, demanded a bribe of 300 euros equivalent to AMD 151,608 for the aforementioned illegal operation. As a result, the perfume subject to customs declaration was found in his luggage by the customs control officials at Zvartnots airport, but it was not declared as a result of the intervention of the bribed official.
Besides, A.Kh. again turned to his acquaintance A.M. for assistance in exporting 120 packs of cigarettes from RA. The authorized official of the customs service of the RA SRC demanded and received 120,000 AMD as a bribe, 1,000 AMD for each pack of cigarettes. As a result, A. Kh. left RA, exporting 120 packs of cigarettes by hiding them in luggage.
Besides, A.Kh. once again appealed to the above-mentioned persons for assistance in hiding the perfumes and cosmetics imported to RA from the customs control and not making the customs payments stipulated by the law. The competent official of the Customs Service of the RA SRC demanded 120,000 AMD as a bribe for the aforementioned illegal operation in favor of A. Kh., which, however, the latter did not transfer to A. M., because the perfume and grooming accessories subject to declaration were found and confiscated during the examination of the luggage belonging to A. Kh. at Zvartnots airport by the employees of the anti-smuggling department of the RA SRC.
A.Kh. was charged under Article 312, part 1 (three episodes) of the RA Criminal Code, and A.M.- under Article 313, part 1 (three episodes) of the RA Criminal Code.
Taking into custody was applied as a measure of restriction to A. Kh. and A. M.
The materials of the criminal proceedings with the indictment were handed over to the supervising prosecutor with a request to confirm it and send it to the court.
Notification. the person accused of a crime is considered innocent until his guilt is proven in accordance with the procedure established by the RA Criminal Procedure Code by a verdict entered into legal force.
