Based on the combination of sufficient evidence obtained during the preliminary investigation of the criminal case examined by the RA Anti-Corruption Committee, it was substantiated that S.A. tried to bribe a police official in the amount of AMD 270,000 at the instigation of A.A. in order to obtain driving licenses, but the crimes were not completed due to circumstances beyond his control.
In particular, A.A., having met his acquaintance S.A., tricked the latter into assuring him that through one of the police officers, for a bribe of AMD 150,000, he could organize the process of obtaining a driver's license without passing theoretical and practical exams. S.A., accepting the offer, transferred AMD 150,000 to A.A. as a bribe to a police official in February 2022 to obtain a driver's license for his friend's son.
Then, A.A. assured S.A. that in order to issue a driver's license to the person he represented, it was necessary to organize the process of obtaining a driver's license by another person for a bribe of AMD 120,000 through a police official. In this way, A.A. persuaded S.A. to bribe the official again. S.A., this time in order to obtain a driver's license for his nephew without passing theoretical and practical exams, in March 2022 transferred AMD 120,000 to A.A. as a bribe to a police official.
Having received the above-mentioned amounts, A.A., knowing in advance the impossibility of fulfilling his promise and not having the intention of bribing anyone or obtaining a driver's license in return, fraudulently stole a total of 270,000 AMD, due to which S.A. could not complete the crimes due to circumstances beyond his will.
For the above-mentioned criminal acts, A. A. was charged under Article 38-34-312, part 1 (2 episodes) of the RA Criminal Code, and S.A. was charged under Article 34-312, Part 1 (2 episodes). Both defendants pleaded guilty to the charges and gave confessions.
The investigation of the criminal case has been completed. The case was confirmed with an indictment by the supervising prosecutor and sent to court.
Notification. the person accused of a crime is considered innocent until his guilt is proven in accordance with the procedure established by the RA Criminal Procedure Code by a verdict entered into legal force.
