In connection with the case of receiving a particularly large bribe by a high-ranking official, the preliminary investigation conducted in the criminal case initiated on the basis of materials prepared by the RA National Security Service and investigated by the RA Anti-corruption Committee factual data were obtained that K. N., occupying the position of deputy prosecutor of Shengavit administrative district of Yerevan city, in order to contribute to the appointment of a lenient punishment against the defendant N.D. in the criminal case being examined in the proceedings of the court of first instance of general jurisdiction of Armavir marz, with the assistance of G.G. and N.A. in the period from January to May 2022, personally received from the defendant a particularly large bribe of 2,500,000 AMD.
According to the charge brought, Deputy Prosecutor of Shengavit Administrative District K. N., according to the agreement reached in advance through G. G. and N.A., on January 16, 2022, in the village of Voskehat, Armavir region, met with the defendant N.D. and discussed the circumstances of the criminal case being investigated regarding the latter. During the meeting, K. N. promised to use his official position to contribute to the court in imposing such a punishment on N. D., which would enable him to be freed from the punishment based on the amnesty law, for which he demanded a bribe of AMD 2,500,000 from the defendant.
According to the verdict of the Court of first instance of general jurisdiction of Armavir Marz dated May 17, 2022, N.D. was sentenced to 6 years of imprisonment, under which conditions he was given the opportunity to be released from the punishment in accordance with the law adopted on November 1, 2018 on declaring amnesty.
On May 19, 2022, K. N. met at G. G.'s house and received from N. D. 2,000,000 AMD of the demanded bribe amount, and the remaining 460,000 AMD N. D. with the help of N.A. on May 31, 2022 transferred to the bank account of a close person of G.G., who cashed the money on the same day and transferred it to the official through G.G.
On 09.06.2022, by the decision of the investigator of the RA Anti-Corruption Committee, the deputy prosecutor of Shengavit administrative district, K. N., N. D., who had given a bribe to the latter, and the persons who assisted in receiving the bribe, were detained.
On 10.06.2022 K. N. was charged with receiving a particularly large bribe under Article 311, part 4, point 2 of the RA Criminal Code. N.D. was charged with giving a particularly large bribe under Article 312, part 3, point 1 of the RA Criminal Code, and N.A. and G.G. were charged with helping to receive a bribe, under Article 38-311 part 4, point 2 of the RA Criminal Code.
Petitions were submitted by the investigator of the RA Anti-Corruption Committee to the Court of General Jurisdiction of the city of Yerevan on selecting taking into custody as a measure of restriction against all the above-mentioned defendants.
The investigation is ongoing.
Notification. the person accused of a crime is considered innocent until his guilt is proven in accordance with the procedure established by the RA Criminal Procedure Code by a verdict entered into legal force.
